The Importance of “Permissive Use” in Auto Accident Lawsuits

by | Aug 12, 2015

Generally, when we bring a claim on behalf of a client injured in an auto accident, we are dealing with the insurance company for the negligent driver who hit our client. But if the negligent driver was not covered by insurance for some reason, that makes it more difficult for us to collect money on behalf of our client. This is why it is important for us to verify that, if the negligent driver didn’t own the vehicle he/she was operating, the negligent driver at least had permission from the owner to drive the vehicle. As long as the driver had permission, he/she will almost always be covered by the owner’s insurance policy.

On the other hand, if the driver did not have permission, then he/she probably will not be covered any insurance policy. For cases like these, it is important to protect yourself by purchasing an uninsured motorist insurance policy, which is insurance that protects you when the negligent driver didn’t have insurance coverage.

If you have been injured in an auto accident and have questions about what insurance is available to compensate you, you should contact the personal injury attorneys at Chaikin, Sherman, Cammarata & Siegel, P.C., for a free consultation.
